Terms of Trade, Returns & Refunds
These Terms of Trade, Returns & Refunds apply to the use of this website and to the purchase, supply, enquiry, quotation, ordering, delivery, return, and refund of products or services supplied by Dewtec Ltd.
By using this website, placing an order, requesting a quote, submitting an enquiry, creating an account, or purchasing products or services from Dewtec, you agree to these terms.
These terms should be read together with our Privacy Policy and Cookie Policy.
About Dewtec
Dewtec supplies hydraulic, pneumatic, hose, fittings, industrial products, servicing, repairs, and related technical support. Products and services may be supplied through this website, over the phone, by email, in person, or through direct account arrangements.
Some products may be standard stock items, while others may be special-order, custom-made, cut-to-length, assembled, ordered from a supplier, or supplied for a specific industrial, trade, commercial, or technical purpose.
Website Information
We aim to keep the information on this website accurate and up to date. However, product descriptions, images, pricing, availability, specifications, stock levels, delivery estimates, and technical information may change from time to time.
Product images are provided for general reference only and may not always show the exact size, finish, colour, packaging, fitting, connection, or specification of the product supplied.
It is your responsibility to check that any product, part, fitting, hose, assembly, or service is suitable for your intended use before placing an order. If you are unsure, please contact us before ordering.
Product Suitability and Technical Advice
Where we provide product information, recommendations, or technical guidance, we do so based on the information available to us at the time.
You are responsible for providing complete and accurate information about your requirements, including measurements, pressure ratings, operating conditions, compatibility, application, environment, machinery details, and any relevant safety requirements.
Dewtec is not responsible for issues caused by incorrect, incomplete, or misleading information provided by the customer, or by products being used for a purpose, environment, pressure, load, chemical, temperature, or application for which they are not suitable.
Quotes and Pricing
All prices are in New Zealand dollars unless stated otherwise.
Prices shown on the website, in quotes, or in communications may be subject to GST, freight, handling, supplier charges, installation, service fees, or other charges where applicable.
Quotes are valid only for the period stated on the quote. If no period is stated, the quote may be subject to change without notice due to changes in supplier pricing, exchange rates, freight costs, stock availability, or product specifications.
A quote does not reserve stock unless this is confirmed by Dewtec in writing.
Orders
Orders may be placed through the website, by email, over the phone, in person, or through an approved customer account.
An order is not accepted until Dewtec has confirmed the order, processed payment where required, or otherwise accepted the order in writing.
We reserve the right to refuse, cancel, or amend an order where there has been an error in pricing, product information, stock availability, freight calculation, payment processing, or where the order cannot reasonably be fulfilled.
Special-Order, Custom, and Made-to-Requirement Products
Some products may be ordered, manufactured, cut, assembled, modified, or supplied specifically for your requirements. This may include special-order items, custom hose assemblies, cut lengths, non-standard fittings, supplier-ordered items, indent items, or products not normally held in stock.
Special-order, custom, cut-to-length, assembled, modified, or made-to-requirement products may not be able to be cancelled, returned, exchanged, or refunded if you change your mind, order the wrong item, provide incorrect details, or no longer require the product.
This does not limit any rights you may have under applicable New Zealand law where a product is faulty, not of acceptable quality, not as described, or does not meet an applicable guarantee.
Payment
Payment must be made using one of the payment methods accepted by Dewtec.
Where online payment is available, payments are processed securely through PCI DSS compliant third-party payment providers. Dewtec does not store credit card details on this website.
Third-party payment providers process payment information in accordance with their own terms, privacy policies, security standards, and data processing practices.
For approved account customers, payment terms will be as agreed with Dewtec. If payment is not received by the due date, Dewtec may place the account on hold, suspend supply, charge recovery costs where applicable, or require payment before further goods or services are supplied.
Stock Availability
Stock availability shown on the website or discussed at the time of enquiry may change without notice.
If an item is unavailable, delayed, discontinued, or unable to be supplied, we may contact you to discuss an alternative product, revised delivery time, backorder, credit, or refund where appropriate.
Delivery, Freight, and Collection
Delivery options, freight charges, and collection arrangements may vary depending on the product, order size, delivery location, supplier availability, and courier or freight provider requirements.
Delivery timeframes are estimates only. We will take reasonable steps to dispatch or arrange supply within a reasonable time, but we are not responsible for delays caused by courier companies, freight providers, suppliers, customs delays, incorrect delivery details, events outside our control, or other circumstances beyond our reasonable control.
Risk in the goods may pass to you once the goods are collected by you, delivered to the address provided, or handed to a courier, freight provider, or authorised representative, unless otherwise agreed in writing.
Checking Goods on Arrival
Please check all goods as soon as possible after collection or delivery.
If goods are damaged in transit, missing, incorrect, or appear to be faulty, please contact Dewtec as soon as possible with your order details, photos where relevant, and a description of the issue.
Delays in reporting delivery damage, missing items, or incorrect supply may make it harder for us to resolve the issue with courier, freight, supplier, or insurance providers.
Returns and Refunds
We will meet our obligations under applicable New Zealand law, including the Consumer Guarantees Act 1993 where it applies.
If a product is faulty, not of acceptable quality, not fit for a particular purpose made known to us, or does not match the description, we will assess the issue and provide a remedy where required by law.
Depending on the circumstances, the remedy may include repair, replacement, refund, credit, or another appropriate solution.
To request a return, refund, repair, replacement, or credit, please contact Dewtec with your order details, proof of purchase, details of the issue, and photos or supporting information where relevant.
Change of Mind Returns
We are not required to provide a refund or exchange if you simply change your mind, order the wrong product, find the item cheaper elsewhere, no longer require the product, or decide that the product is not suitable after purchase where the product was correctly supplied.
However, Dewtec may consider change of mind returns at its discretion for standard stocked items, provided the item is unused, undamaged, in original condition, in original packaging, and returned within a reasonable time.
Any approved change of mind return may be subject to inspection, supplier approval, freight costs, handling costs, or restocking fees where applicable.
Special-order, custom, cut-to-length, assembled, modified, electrical, opened, used, damaged, or non-resaleable items will generally not be accepted for change of mind returns.
Faulty or Incorrect Products
If you believe a product is faulty or has been incorrectly supplied, please contact us before returning the item.
We may need to inspect the product, request photos, consult with the supplier or manufacturer, or assess whether the issue has been caused by a product fault, incorrect use, incorrect installation, unsuitable application, normal wear and tear, contamination, modification, damage, or lack of maintenance.
If the product is confirmed to be faulty or incorrectly supplied and a remedy is required by law, we will arrange an appropriate remedy.
Non-Returnable Items
Unless required by law, the following items are generally not returnable:
- Special-order items
- Custom-made or modified products
- Cut-to-length products
- Hose assemblies or made-to-requirement items
- Products ordered specifically for the customer
- Used, installed, damaged, contaminated, or altered items
- Items not in original condition or packaging
- Items that cannot be safely or reasonably resold
This does not limit any rights you may have under applicable New Zealand law where a product is faulty or where a legal remedy is required.
Return Freight
Unless otherwise agreed, customers are responsible for return freight costs for change of mind returns, incorrectly ordered items, or items returned for reasons not caused by Dewtec.
If a product is confirmed to be faulty or incorrectly supplied by Dewtec, we will discuss reasonable return freight or replacement arrangements with you.
Refund Processing
Approved refunds will usually be processed back to the original payment method where possible.
Refund processing times may depend on the payment provider, bank, card provider, or account process used for the original payment.
Delivery, freight, handling, special-order, supplier, or service charges may not be refundable unless required by law or agreed by Dewtec.
Consumer Guarantees Act and Business Purchases
Where you purchase goods or services for personal, domestic, or household use, you may have rights under the Consumer Guarantees Act 1993 and other applicable New Zealand consumer laws.
Where goods or services are supplied for business, trade, commercial, manufacturing, production, repair, resale, or industrial purposes, you agree that the Consumer Guarantees Act 1993 will not apply to the maximum extent permitted by law.
Nothing in these terms is intended to exclude, restrict, or modify any rights that cannot legally be excluded, restricted, or modified.
Warranties
Some products may include a manufacturer’s warranty or supplier warranty. Warranty terms, coverage, exclusions, and claim processes may vary depending on the product and manufacturer.
Warranty claims may require proof of purchase, photos, inspection, testing, return of the product, supplier assessment, or manufacturer approval.
Warranties may not cover incorrect installation, misuse, incorrect application, normal wear and tear, contamination, unauthorised modification, lack of maintenance, accidental damage, or use outside the manufacturer’s specifications.
Limitation of Liability
To the maximum extent permitted by law, Dewtec will not be liable for indirect loss, loss of profit, loss of revenue, loss of production, loss of business opportunity, downtime, delay, damage to equipment, or consequential loss arising from the use of this website, products, services, delays, supply issues, or inability to use a product.
Where Dewtec is liable and that liability cannot be excluded, our liability will be limited to the remedy required by law or, where permitted, the amount paid for the relevant product or service.
